Born in Canada, playing for Canada is a fine line.

As an example, if someone born in Newfoundland in 1940, as an example, would he be considered to be Canadian born?

Such a person can claim dual citizenship (British and Canadian). The Canadian citizenship became effective on April 1, 1949.

Are you sure about the dual citizenship? I asked my wife is she has dual citizenship for that reason and she doesn't think that's the case.

In order to claim the dual citizenship, your wife must write it on her scoresheet, stop the clock and summon the arbiter. :D

A few months ago, I had the opportunity to spend a few dozen hours researching this exact question. I've summarized some of the findings below:

                1. Prior to 1949, citizens of Newfoundland had the status of British subjects.

                2. The 1948 British Nationality Act, which came into force on 1 January 1949,
introduced the status of citizen of the United Kingdom and
Colonies (CUKC). Pre-Confederation Newfoundlanders fall into this category.

                3. The 1971 British Immigration Act, which came into force on 1 January 1973, introduced the concept of patriality. A patrial is a person who has a "right of abode" in the United Kingdom. Pre-Confederation Newfoundlanders acquire the "right of abode" under Section 2 of this Act.

                4. The 1981 British Nationality Act, which came into force on 1 January 1983.
According to the United Kingdom government website http://www.ukba.homeoffice.gov.uk/

Section 15.3.1 of that Act provides that all CUKCs who had the right of abode acquired British citizenship automatically at commencement of the Act.

This is the basis for my conclusion that pre-Confederation Newfoundlanders qualify for British citizenship in addition to the Canadian citizenship they acquired on April 1, 1949.

Thanks for the info. Probably such citizenship would have to be claimed.

Strictly for academic reasons, how does this translate to her family? The act seems very wide ranging.

Is it certain you'll get in? The regulations say first 40 players over 2300 FIDE.
